General Terms and Conditions of Purchase

Agreement to and availability of the General Terms and Conditions of Purchase. By agreeing to this contract, you hereby declare that

A) You are of legal age and you have the capacity to contract
B) You have read and agree to these general terms and conditions. These general terms and conditions govern the legal relationship arising from the contract processes that take place between users/customers (hereinafter, “Customers”) of the e-commerce website at URL www.roidal.com owned by ROIDAL, S.L.

Customers agree to the General Terms and Conditions from the moment they use, sign up for or purchase any product. This document may be printed out and stored by Customers. In the event of any amendment to these General Terms and Conditions, Roidal, S.L. shall always honour the ones that the user agreed to at the time of purchase. Users may address any queries regarding the General Terms and Conditions or request a copy of them in case of loss by writing to the email address eshop@roidal.com.

Amendment to the General Terms and Conditions

ROIDAL, S.L. may amend the General Terms and Conditions by notifying Customers sufficiently in advance, in order to improve the services and products offered through www.roidal.com. By amending the General Terms and Conditions published on the website www.roidal.com, this duty of notification shall be understood to be fulfilled. In any case, please read the General Terms and Conditions before using any services or purchasing any products.

Description of products and services Exchange and returns

You have 14 days after receiving your order to exchange one item for another size or request a refund. To do so, you can request free home pickup and we will send DHL to pick up your parcel or you may take your parcel to any DHL drop-off point:

1. Send an email to eshop@roidal.com and specify the order you want to return.
2. Pack your items securely, in the original packaging if possible, and include the delivery note. It is important for you to specify whether you want a size exchange or a refund for the corresponding items. If there is more than one product, please specify the product to be returned.
3. Once you have followed the instructions above, you will receive an email confirming the size exchange or refund requested and containing the steps to follow to request pickup on the DHL website.
4. If it is a return, refunds can only be sent back to the original payment method used during purchase within 10 to 15 working days after we receive your parcel at our warehouse.
5. If you prefer another size, you can request it at the time of return. To do so, please specify the item you wish to exchange and the new size on the delivery note. If this size is not available, we will reimburse you the amount of the item. If you prefer to exchange the item for another model or colour, you will have to return the item and place another order.
6. The shipping costs and risks associated with product returns or exchanges will be borne by the Customer, except for the first return, which will be borne by ROIDAL, S.L.
7. For all exchanges and returns, please bear in mind that: due to the nature of our products and for hygiene reasons, we will refuse the return of any item that shows any signs of tampering. All items must be exchanged and returned with their original packaging and all tags and labels attached. All items must be in the same condition you received them. They will be inspected on return.

Right of Withdrawal

Customers in the European Union have 14 calendar days, from the date of receipt of their order, to cancel their order made at www.roidal.com.

You may use the sample withdrawal form below, although its use is not mandatory. To meet the withdrawal deadline, it is enough for you to send the letter wherein you exercise this right before the withdrawal period has expired.

Reimbursement will be made no later than 14 calendar days from the date on which you informed us of your decision to withdraw from this contract. We will refund the money using the same payment method used by you during the initial purchase, unless you have expressly stated otherwise; in any case, you will not incur any fees as a result of the refund. We may withhold your refund until we have received the goods or until you have provided us with proof of their return, whichever happens first.

The product offering at www.roidal.com is valid indefinitely and may be amended, rectified or cancelled without prior notice to regular or occasional users and consumers. Civil liability of www.roidal.com for the products supplied is limited to their amount. The user or consumer waives any and all claims for liability to www.roidal.com for any item in case of dissatisfaction with the products purchased at www.roidal.com, as well as possible failures, slow access or errors in accessing the website, including loss of data or other types of information that could exist on the computer or network of the user accessing www.roidal.com.

Shipping and delivery information

Orders are processed Monday through Friday from 9:00 a.m. to 12:00 noon. Orders placed on Friday after 12:00 noon will be processed the following Monday. Products in stock will be processed and dispatched within 24 business hours of receipt of payment.

Shipments are made exclusively to the continental United States of America, Alaska and Hawaii. Shipments are not made to post office boxes.

Customs duties and taxes

Shipments to destinations outside the European Union are exempt from Spanish taxes. Nevertheless, countries have the right to impose other customs duties or taxes. This cost will be determined once the parcel arrives to the country of destination. Customs duties and taxes will be paid by the recipient of the parcel, who will pay the fees to the carrier or the relevant customs authority.

Failure of customs clearance

It is the recipient’s responsibility to ensure that their parcel is suitable for customs clearance and it contains all the information required for the customs procedures. Shipping costs are added when placing the order. Shipping costs will be borne by the customer for purchases under €200 (mainland Spain, Balearic Islands and mainland Portugal) and will be added at the end of the ordering process.

We reserve the right to change prices on the website without prior notice. Shipping costs are added when placing the order. In any case, an invoice will be sent to the customer upon confirmation of receipt of payment. Any other order confirmation (received by email or printed from the website) will be legally valid as proof of purchase but not as an invoice.

Payment method

Purchases made through this website are subject to the payment of value-added tax (VAT), as set out in the current regulations. All prices shown on our website are in euros (€), VAT inclusive and valid, except for typing errors.

Payment for the price of the products and the relevant shipping costs may be made using a Spanish credit or debit card (VISA, MASTERCARD, VISA ELECTRON or other similar cards) or a Paypal account. ROIDAL, S.L. undertakes to use the most efficient and secure methods of current technology to transmit data and payments for each transaction. These transmissions will always be encrypted through a secure server. The bank card used for payment must be issued by a Spanish bank. If the user chooses to pay using a credit card, the bank details will be transmitted through a security protocol by CaixaBank or other banks providing the relevant remote electronic payment services. Under no circumstances will any third party have access to them. Such data will never be used by ROIDAL, S.L. except to carry out the procedures related to the purchase, to issue the relevant refunds in case of subsequent returns and to prevent and inform the police forces in case of any fraud committed or that is about to be committed at www.roidal.com.

The purchase price of the products and the shipping costs will be debited from the user’s current account upon order confirmation.

How to place an order

Although using the website www.roidal.com does not entail mandatory registration as a USER, to purchase a product, it is essential to sign up as a USER after agreeing to our Privacy Policy and these General Terms and Conditions of Purchase governing the service. Available products are found in our online shop. Customers may purchase any product in the shop by accessing the section that is of interest to them using the tabs at the top. After accessing the product, click on it to see it in greater detail and get more information. For each of the products, ROIDAL, S.L. has made every effort to provide the most accurate description of the product’s characteristics, both in terms of its photograph and the text accompanying it. If you want to purchase the product, click on the “Add to Cart” button and continue shopping for the products you want.

If you want to purchase more than one piece of a product, change the number in the “Quantity” field. The application will immediately update the purchase you are making and the relevant shipping costs. Once you’ve added all the products to the “Cart” and you want to finalise the purchase and validate the order, click on “Finalise Purchase”. To place an order for one or more products at www.roidal.com, the user must follow the steps indicated in the purchasing process, filling in all requested data, confirming the purchase of the products added to the Cart and completing payment for the order. Upon confirming the purchase of the products added to the Cart, the user will have all the information related to the order being processed (including the cost for shipping the order to the specified address) and all corresponding contractual information. The user purchasing products on the website agrees to pay upon confirming their order. Thus, the order will not be processed until ROIDAL, S.L. receives the confirmation of payment.

Once the order has been placed, the user will receive an order confirmation via email listing the products purchased and their prices, the shipping costs, the payment method, the shipping address and other contractual information on the transaction. The user may access their orders by going to the “Account” > “Orders” section.

ROIDAL, S.L. may refrain from processing orders submitted by users who do not offer an adequate guarantee of solvency, who provide incomplete or inaccurate data, and also in the event that the selected products are not available.

In such cases, ROIDAL, S.L. will notify the user via email that the order has not been processed successfully, specifying the reasons for this, and if necessary, will reimburse the amount paid for products that are not available.

Security

Your credit card information will be sent encrypted through the secure payment gateway. This way, nobody – not even staff of www.roidal.com – will ever have access to this data. The use of electronic payment systems with credit cards in one of the following circumstances constitutes a cybercrime as provided for in Article 248 of the Criminal Code and punishable with up to 6 years of imprisonment:

The user provides false information about the buyer or the card used.
Using the details of a person other than the buyer.
Providing card numbers that do not match the buyer’s card number.
Masquerading as the cardholder of someone else’s card.
Using card numbers generated by computer programs or similar algorithms.
The company reserves the right to refuse delivery of the order when its in-house identification systems warn it of the possibility of irregularities in the transaction.

Intellectual Property

The content provided by www.roidal.com is subject to intellectual and industrial property rights exclusively owned by ROIDAL, S.L. Purchasing a product or service from ROIDAL, S.L. does not grant the buyer any right to alter, exploit, reproduce, distribute or publicly communicate it, with ROIDAL, S.L. reserving all these rights.

The transfer of the aforementioned rights shall require the prior written consent of ROIDAL, S.L. The Customer may not make such content available to third parties. The intellectual property rights extend to – aside from the content found on www.roidal.com – to its graphics, logos, design, images and source code used for its programming.

Use of the service and liability

ROIDAL. S.L. does not guarantee the ongoing availability of the services, and shall not be liable for any possible damage caused due to the unavailability of services due to force majeure or errors in the data transfer networks beyond its control. ROIDAL, S.L. shall not be liable for the content of links to other websites not owned by it and therefore cannot be controlled by it. The Customer declares that they are aware that the information provided by ROIDAL, S.L. through its services has no legal force and is only offered for general information purposes only.

Privacy and Protection of Personal Data

By providing their email address or other personal data, which is necessary to engage any service herein, Customers grant their consent for such data to be processed and used to send commercial communications for the promotion or advertising of the services and products offered by www.roidal.com. ROIDAL, S.L. puts the email address eshop@roidal.com at the disposal of Customers for them to revoke any consent given, as well as to exercise their rights to access, modify, delete and object to processing guaranteed under current legislation. ROIDAL, S.L. declares that it complies with current legislation on data protection, specifically Organic Law 15/1999 of 13 December on the Protection of Personal Data and Royal Decree 1720/2007 of 21 December implementing the aforementioned organic law.

Applicable law and competent jurisdiction

These General Terms and Conditions shall be governed and interpreted according to Spanish law.

Notifications

All notifications, requirements, requests, and other communications to be made between the parties in relation to these General Terms and Conditions must be done so in writing. They shall be understood to have been duly carried out when they are hand delivered or sent via regular mail to the address of the other party or to their email address, or to any other address or email address that each party may specify to the other for this purpose.

Clauses Declared Null and Void

Should any clause in these General Terms and Conditions be declared, totally or partially, to be invalid or unenforceable, such invalidity or unenforceability shall only affect the provision or the part of it that is invalid or unenforceable, and the General Terms and Conditions shall remain in force in all other respects. The provision or the part of it that is affected shall be regarded as not included. ROIDAL, S.L. shall assume no liability whatsoever for the improper, inappropriate or unlawful use of the information that appears in the ROIDAL, S.L. web pages.

Within the limits established by law, ROIDAL, S.L. assumes no liability for the lack of veracity, integrity, relevance and accuracy of the data or information contained in its web pages. The content and information in the ROIDAL, S.L. web pages are obtained from contributors and other news sources. Nevertheless, the content and information neither bind ROIDAL, S.L. in any way nor do they constitute opinions, advice or legal advice of any kind as these are merely for general information and education purposes.

The ROIDAL, S.L. web pages may contain links to other third-party web pages that ROIDAL, S.L. has no control over. Therefore, ROIDAL, S.L. shall assume no liability whatsoever for the content that may appear in third-party web pages.
